Aesplore (Pty) Ltd – Terms and Conditions
1. Introduction
These terms and conditions ("T&Cs") govern your booking and participation in tours and services provided by Aesplore (Pty) Ltd ("Aesplore"), a private company registered in South Africa. By booking or participating in our tours, you agree to these terms.

2. Bookings and Reservations
2.1. A booking is confirmed when Aesplore (Pty) Ltd receives a deposit or full payment as outlined in the payment section.
2.2. Upon confirmation, the booking becomes a binding contract between the customer and Aesplore (Pty) Ltd.
2.3. Customers are responsible for reviewing the details of their booking to ensure that all information provided is accurate.
3. Payment Terms
3.1. A non-refundable deposit of 10% is required at the time of booking to secure your reservation.
3.2. Full payment must be made no later than 60 days before the tour's departure.
3.3. Failure to make timely payments may result in cancellation of the booking, subject to the cancellation terms outlined below.
4. Cancellations by the Customer
4.1. Customers may cancel their booking by providing written notice to Aesplore (Pty) Ltd.
4.2. The following cancellation fees will apply:
For bookings made more than 60 days before the start date:
The cancellation fee is 0% for cancellation within the first 48 hours of booking.
The cancellation fee is 20% for cancellations more than 60 days before the start date of the trip.
The cancellation fee is 100% for cancellations within 60 days before the start date of the booked services.
For bookings made within the 60-day period before the start date:
The cancellation fee is 100% if canceled at any point after the booking is made.
4.3. In accordance with the Consumer Protection Act (CPA), if the customer cancels due to unforeseen circumstances (e.g., hospitalization, death, or other serious circumstances), Aesplore (Pty) Ltd may, at its discretion, offer a refund, minus any reasonable costs already incurred in connection with the booking.
5. Cancellations or Changes by Aesplore
5.1. Aesplore reserves the right to cancel or make changes to any tour due to circumstances beyond our control, including but not limited to natural disasters, weather, governmental actions, pandemics, or any other events deemed to be force majeure.
5.2. In the event of a cancellation by Aesplore due to force majeure, Aesplore will not be liable to offer a refund. Instead, customers will be offered the option to reschedule the tour for a future date or receive a credit for a future booking of equal value.
5.3. If the cancellation is due to an insufficient number of participants, Aesplore will notify you at least 21 days before the scheduled tour date, and in such cases, you may choose between a full refund or an alternative tour of equal value.
6. Liability, Indemnity, and Protection of Employees and Contractors
6.1. Participation in our tours involves inherent risks. By booking, you agree to assume all risks associated with the tour and release Aesplore (Pty) Ltd, its directors, employees, contractors, guides, agents, and representatives ("Aesplore Staff") from any liability related to accidents, injuries, illness, or loss of property during the tour.
6.2. You agree to indemnify and hold harmless Aesplore (Pty) Ltd and Aesplore Staff against any claims, damages, or losses resulting from your breach of these T&Cs, your negligence, or your participation in activities outside the scope of the tour.
6.3. Aesplore (Pty) Ltd, including its employees and contractors, shall not be held liable for any injury, damage, or loss caused by third-party services or providers, such as accommodation or transportation providers.
6.4. Aesplore Staff may refuse participation to any individual whose behavior is deemed unsafe or inappropriate. In such cases, no refund will be given, and the individual assumes all risks and liability for their actions.
7. Travel Insurance
7.1. Aesplore (Pty) Ltd requires all participants to obtain comprehensive travel insurance prior to the commencement of the tour. This insurance must cover personal injury, medical expenses, repatriation costs, trip cancellations, loss of luggage, and any other travel-related risks.
7.2. By participating in the tour, you acknowledge that Aesplore (Pty) Ltd is not responsible or liable for any expenses, damages, or losses that could be covered by your travel insurance. This includes, but is not limited to, costs arising from trip cancellations, personal injury, medical emergencies, theft, or loss of personal belongings.
7.3. It is the responsibility of the participant to ensure that their travel insurance policy is adequate and valid for the entire duration of the tour. Aesplore (Pty) Ltd will not be liable for any failure on the part of the participant to obtain suitable insurance or for any exclusions or limitations in their coverage.
8. Itinerary and Accommodations
8.1. Aesplore provides detailed descriptions of the itinerary and accommodations. However, itineraries may change due to operational reasons. Any changes will be communicated to you as early as possible.
8.2. Accommodation rules (e.g., check-in/check-out times, smoking, pets) must be adhered to, as stated on our website or provided by our partners.
9. Customer Conduct
9.1. Customers are expected to behave respectfully during the tour. Aesplore reserves the right to remove any participant from a tour for unsafe or inappropriate behaviour, without a refund.
9.2. Customers agree to comply with any health and safety measures implemented by Aesplore and its staff during the tour to protect all participants, employees, and contractors.
10. Complaints
10.1. Any complaints should be communicated to our customer service team during the tour or at the earliest opportunity thereafter. Complaints must be lodged in writing within 14 days after the end of the tour.
11. Data Protection and Privacy
11.1. Aesplore collects personal information for booking purposes. We are committed to protecting your data and complying with the Protection of Personal Information Act (POPIA). By making a booking, you consent to the collection and use of your data as described in our Privacy Policy.
12. Force Majeure
12.1. Aesplore (Pty) Ltd shall not be held liable for delays, changes, or cancellations due to force majeure events. In such cases, you may receive a refund or a credit for future bookings.
13. Protection of Employees, Contractors, and Subcontractors
13.1. Aesplore (Pty) Ltd employs and contracts with third-party service providers, including tour guides, drivers, accommodation providers, and subcontractors. By agreeing to these T&Cs, you acknowledge that Aesplore is not liable for any actions, errors, or omissions of such independent contractors.
13.2. Any claims arising from the negligence or misconduct of third-party service providers must be directed to them and not to Aesplore (Pty) Ltd or its employees.
13.3. Aesplore employees and contractors are authorized to enforce company policies, safety measures, and any relevant regulations during the tour.
14. Governing Law
14.1. These T&Cs are governed by the laws of South Africa. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
15. Entire Agreement
15.1. These T&Cs, along with your booking confirmation and our privacy policy, constitute the entire agreement between you and Aesplore. No other statements or communications shall alter the terms unless agreed upon in writing by Aesplore (Pty) Ltd.
